The sole petitioner, who is in custody since 07.04.2016, as indicated in the order dated 13.06.2016 passed by the learned Sessions Judge, Nalanda in Giriyak P.S. Case No.89 of 2016, G.R. No.04/2016 registered for the offence under Section 20(B)(i)(ii ) of the N.D.P.S. Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner has been falsely implicated showing recovery of Ganja to the tune of 1 Kg.100 gms. He submits that recovered Ganja is lesser than the smaller quantity, but only with a view to create a case it was shown as 1 Kg.100 gms. He submits

Patna High Court Cr.Misc. No.48259 of 2016 (2) dt.20-12-2016 2/2 that earlier he has been made accused relating to property dispute, otherwise the petitioner is having clean antecedent. Learned Addl. Public Prosecutor has opposed the prayer for grant of bail of the petitioner.

However, considering the period of custody as well as quantity of recovered Ganja, let the petitioner, namely, Karu Singh@ Shiv Shankar Singh be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, Nalanda at Biharsharif in connection with Giriyak P.S.
