Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a),30(g)38(i)(ii),41 of Bihar Prohibition and Excise Act, 2016 and 25(1-b)a,/26/35 of the Arms Act.
A loaded country made pistol and liquor was recovered from possession of the petitioner. Petitioner is in custody since 03.01.2020. Investigation of the case is already complete.
Considering the completion of investigation and period already undergone by the petitioner as undertrial prisoner as well as the fact that there is no material to substantiate that the petitioner is going to tamper with the evidence, let the
Patna High Court CR. MISC. No.19218 of 2020(11) dt.03-12-2020 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Runnisaidpur Police Station Case No.02 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
