The petitioner has invoked the jurisdiction of this Court seeking a direction upon the concerned respondents to grant promotion on the post of Trained Graduate Teacher (Science) as well as Headmaster with effect from the date she is entitled according to the Rules and Regulation along with all the consequential benefits with penal interest.
3. It is submitted that the petitioner was duly
Patna High Court CWJC No.6956 of 2026 dt.14-07-2026 2/3 appointed as an Assistant Teacher on compassionate ground in the year 2001 by the order of the District Superintendent of Education, Nalanda. While she was working as Assistant Teacher, in the meanwhile, she was transferred from the District of Nalanda to Patna in the year 2007 and since inception from the date of joining, the petitioner has been discharging her duty as an Assistant Teacher, but her case has never been considered for promotion as Graduate Trained Teacher (Science) nor for the post of Headmaster/Headmistress.

It is the specific case of the petitioner that other identically situated persons have been extended the benefit of promotion as Graduate Trained Teacher, besides they were promoted to the post of Headmaster, but discrimination has been caused to the petitioner without any justifiable reason contrary to the Rules and Regulations. For redressal of the grievance, the petitioner has approached the District Programme Officer (Establishment), Patna by filing a detailed representation on 09.03.2026, but no decision has been taken till date.
5. Learned Advocate for the State sought an adjournment to seek instruction and ensure filing of the counter affidavit.
6. Having considered the limited grievance of the
Patna High Court CWJC No.6956 of 2026 dt.14-07-2026 3/3 petitioner with respect to promotion as Graduate Trained Teacher as well as Headmaster/Headmistress, based upon the fact that other identically situated persons have been extended such promotion, this Court deems it appropriate to dispose of the writ petition with a liberty to the petitioner to file a detailed representation specifically giving the name of the Assistant Teacher/Teachers with whom she is seeking parity, besides the other materials in support of her claim, preferably within a period of two weeks from today.
7. In case, such representation is filed, the Programme Officer (Establishment), Patna shall consider the same and dispose of by a reasoned and speaking order within a further period of eight weeks.
8. In case, the claim of the petitioner finds favour, necessary consequential order shall be passed.
9. The writ petition stands disposed of.
