JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Maniyari P.S. Case No. 321 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. No incriminating material has been recovered from the conscious possession of the petitioner. Similarly situated co-accused Sanjeet Ray has been granted bail vide order dated 06.08.2022 passed in Cr. Misc. No. 29310 of 2022. Petitioner is in custody since 05.02.2023. Learned APP has vehemently opposed the prayer for

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, court no.-II, Muzaffarpur in connection with Maniyari P.S.
