The petitioner is accused in connection with Piprakothi P.S. Case No. 53 of 2018 registered under Sections 302 and 120B of the Indian Penal Code.

The accusation is that Alok Kumar, son of the informant, left his house, at about 8 P.M., on 13.04.2018, towards Pipra Bazaar but he did not return till next morning. On 14.04.2018, father-in-law of his son informed that the dead body of his son has thrown in the paddy field, where his motorcycle was standing. Thereafter, informant along with others reached there and saw the dead body of his son and lodged the F.I.R. against unknown.

No.62473 of 2018(2) dt.08-10-2018 2/2 Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather his name has surfaced on detecting the mobile location near the place of occurrence and thereafter, petitioner was apprehended by the police, who got recorded his confessional statement, except that nothing has been collected against the petitioner showing the involvement in the present case. It is further submitted that petitioner has no criminal antecedent and is in custody since 26.04.2018. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, in connection with Piprakothi P.S. Case No. 53 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
