JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2017 The petitioner is apprehending his arrest in connection with Katihar (Town) (Sahayak) P.S. Case No. 761 of 2016, registered for offences punishable under Sections 341, 323, 353, 379, 385, 504/34 and 506 of the Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner happens to be the school teacher of a private school situated near the school in which the informant is headmistress and only allegation against the petitioner is that he along with other co-accused of this case entered into her chamber abused her and thrashed her on the ground, however no injury was caused to the informant. It has further been submitted that the petitioner has no criminal antecedent and is ready to abide by any condition imposed on him for grant for anticipatory bail. Heard learned A.P.P. also.

No.6296 of 2017 (2) dt.21-02-2017 2/2 Having heard both sides, in view of the submissions of the parties, let petitioner surrenders and raise all these points before the Court below itself, who will examine the submissions of the petitioner as well as the allegation made against him and also considering the fact that the petitioner is a teacher, shall pass an appropriate order, if possible, on the very same day, without being prejudiced by the order of this Court.

With the above observation, this application is disposed of.
