The petitioner seeks bail in a case instituted for the offence under Sections 379 and 411/34 of the Indian Penal Code. It is alleged that when the informant reached near Railway Officer Rest House, two persons reached by motorcycle and one man took mobile and fled away towards Rajwara Colony. The informant raised hulla then on chase one boy was caught hold but another managed to escape. The boy, who was caught, told his name Raj Ballav Yadav and in presence of witnesses one mobile was recovered from the possession of petitioner. It has been submitted on behalf of the petitioner that petitioner has clean antecedent. There is no identifying mark on mobile phone. He has been implicated in this case merely on
Patna High Court Cr.Misc. No.64151 of 2018 (2) dt.25-10-2018 2/2 suspicion. He has been in custody since 11.07.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Railway Barauni, District-Begusarai in connection with Barauni G.R.P.S. Case No.112/2018.
