JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Giriyak (Katridara) P.S. Case No. 255 of 2018 dated 05.07.2018 instituted for the offences under Sections 419, 420, 467, 468, 471 of the Indian Penal Code and Section 66 of the Information Technology Act, 2000.
The petitioner and about six others were apprehended by the Police trying to cheat persons and accepting money from them on the pretext of giving them
Patna High Court Cr.Misc. No.63919 of 2018(2) dt.13-12-2018 2/3 prizes by a mobile company. No sooner had they assembled and started counting names of such persons who would have been given prizes, the Police Party came and they ran away. The learned counsel for the petitioner has submitted that the name of the petitioner has been given to the Police by some persons who have inimical terms with him. It has further been submitted that the offence could not be completed and remained inchoate.
The petitioner does not have any criminal antecedents and even if the allegations in the F.I.R is accepted to be ex-facie true, no offence can be said to have been made out.
Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today before the learned Court below, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Nalanda at Biharsharif in connection with Giriyak (Katridara) P.S.
