(i) For quashing the Work Order dated 13.4.2009 as contained in Memo No.
W/362/09/Jatropha Curcus/ADEN/1/W-2(Annexure-1), whereby Respondent No. 5 has been allotted one year maintenance work of Plantation on both side of the Railway land boundary in block section under the jurisdiction of the respondent no. 3. (ii) For issuance of a direction to the respondent no. 3 and 4 not to give effect to the order contained at Annexure-1 impugned.
(iii) For a further direction to the respondent no. 5 not to disturb the peaceful possession of the Petitioner over the land in question."
has fairly submitted that in view of the stand taken by the respondents in the counter affidavit that now dispute has been referred to the arbitrator, does not intend to press this writ application.
That being so, this writ application is disposed of as
Patna High Court CWJC No.9462 of 2009 (3) dt.30-01-2015 2/2 having become infructuous.
