JUSTICE ARUN KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner, who is in custody, seeks bail in connection with Bihta P.S. Case No. 809 of 2016 registered under Section 30(a) of the Bihar Excise (Amendment) Act, 2016. Prosecution case, in brief, is that 25 litres of Mahua liquor were recovered from the petitioner. It is alleged that he was selling the liquor.

Learned counsel for the petitioner submits that allegation is false and fabricated and nothing was recovered from his possession and no person drinking the same was also apprehended. The petitioner has got clean antecedent and has been in custody since 21.10.2016.

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.54174 of 2016 (2) dt.21-12-2016 2/2 circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur in connection with Bihta P.S. Case No. 809 of 2016.
