The petitioner apprehends his arrest in connection with Birpur P.S. Case No. 101 of 2018, registered for the offences punishable under Sections 467/468/471/420/120 (B)/34 of the Indian Penal Code.

Petitioner is said to have obtained employment as Panchayat Teacher on the basis of mark-sheet which is found to be forged and fabricated after due verification. It is submitted by the learned counsel for the petitioner that petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case. As a matter of fact, he has furnished his mark-sheet at the time of joining and after verifying the same by the authority concerned he was allowed to join the service and he has no knowledge of manipulation in his certificate by someone later on with ulterior

Patna High Court CR. MISC. No.28760 of 2019(3) dt.05-08-2019 2/2 motive. He is lying on suspension. He is ready to co-operate in the investigation by presenting himself whenever and whereever required. Since the case is based on the document hence there is no chance of tampering of evidence at the hands of the petitioner and similarly situated co-accused Suchita Kumari has been enlarged on anticipatory bail by a co-ordinate Bench of this Court passed in Criminal Miscellaneous No. 74679 of 2018 vide order dated 21.12.2018. He has no criminal antecedent. On the other hand, learned A.P.P. for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Begusarai in connection with Birpur P.S. Case No.101 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) T.Kr./- U T
