2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

3 . It is alleged that 2 liters illicit cough syrup was recovered from bamboo orchard.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case on the basis of confessional statement of other co-accused persons. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got 1 criminal antecedent. 5 . Learned counsel for the State opposes the bail

Considering the fact that no incriminating material has been recovered from conscious possession of this petitioner and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive spevial Judge (Excise) II Saharsa in connection with Saharsa Sadar Police Station Case No. 1297 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
