The petitioner seeks bail in connection with Kursakanta P.S. Case No. 141 of 2018, registered under Section 414 of the Indian Penal Code.
The accusation is that on receiving secret information about keeping of the motorcycle in the house of petitioner, the informant and other Police officials reached there and one Rahul Kumar Jha was apprehended, who disclosed about keeping of stolen motorcycle in the courtyard of the petitioner. Thereafter, one motorcycle, without number plate, was recovered from the courtyard of the petitioner, but he did not produce any paper regarding the ownership of the said vehicle.
Learned counsel for the petitioner submits that, in
Patna High Court Cr.Misc. No.62517 of 2018(2) dt.08-10-2018 2/2 fact, Rahul Kumar Jha is relative of the petitioner, who used to reside at Purnia and at that time he had come at the house of the petitioner, in relation, in the meantime, Police raided and recovered the motorcycle. The petitioner has no criminal antecedent is in custody since 25.06.2018.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-V, Araria in connection with Kursakanta P.S. Case No. 141 of 2018, subject to the condition that one of the bailors must be parents/close relative of the petitioner.
