Mr.Sc12- Prabhat Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 25-02-2019 Heard learned counsel for the petitioner and the State. This writ application has been filed by the petitioner for the following reliefs:
"I. For issuance of directions, order or writ in the nature of mandamus directing the respondents not to disturb the right to live with dignity and liberty of the petitioner as a citizen of India to pursue the studies of IAS exams which has been infringed and disturbed by the Police Officials of S.K. Puri Police Station, Patna on the persuasion of wife of the petitioner, Smt. Manisha Prasad D/o Smt. Shobha Prasad and Lal Bahadur
Patna High Court CWJC No.19336 of 2014(2) dt.25-02-2019 2/3 Prasad, house no. 111 Shri Krishna Puri, P.S. S.K. Puri, P.O. Anandpuri, District-Patna who is presently posted as Block Development Officer, Pandarak by their colorable exercise of power by which the petitioner was detained in S.K.Puri Police Station in the night of 14-10-2014 right from 2 A.M. till morning 7 A.M. under great stress, humiliation, threat and virtually being bewildered and remained virtually in collapsing position throughout the period of illegal detention without any crime, cause rhyme or reason.
II. For issuance of directions, order or writ in the nature of mandamus directing the respondents to punish the guilty officials for their illegal act of wrongful detention of the petitioner in S.K. Puri Police Station in the night of 14-10-2014 right from 2 A.M. till morning 7 A.M.
III. For issuance of directions, order or writ in the nature of mandamus against the respondents for their explanation to the Hon'ble Court as to why and under what offense and law the petitioner was detained for his no fault and no offense having been committed by him.
IV. For issuance of directions, order or writ in the nature of mandamus directing the respondents topay heavy compensation to the petitioner for uncalled for and illegal detention for humiliation of the petitioner as a citizen.
V. For issuance of directions, order or writ in the nature of mandamus directing the
Patna High Court CWJC No.19336 of 2014(2) dt.25-02-2019 3/3 respondents to pay the cost of the case to the petitioner.
VI. Any other relief or reliefs for which the petitioner is deemed entitled to".
After some arguments, counsel for the petitioner seeks permission to withdraw this writ application with a liberty to approach the competent authority.
Permission is accorded.
This writ application is dismissed as withdrawn with the aforesaid liberty.
