JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-12-2016 Heard leaned counsel for the petitioner and the leaned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ayer P.S. Case No. 36 of 2016, registered under Sections 376 and 511 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Bhojpur at Ara.

The accusation is that on 14.06.2016 at 12.00 Noon, the petitioner entered in the house of the informant and attempted to commit rape upon the informant, but on protest and raising alarm by the informant, petitioner fled away from there. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The

Patna High Court Cr.Misc. No.45860 of 2016 (2) dt.13-12-2016 2/2 petitioner is directed to surrender before the trail Court within six weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
