The petitioners seek bail in Sakra P. S. Case No. 19 of 2019 instituted for the offence under Section(s) 341, 323, 307, 302, 120B/34 of the Indian Penal Code and Section 27 of Arms Act.
Learned counsel for petitioners has submitted that petitioners are not named in the written report. In the written report it is alleged that brother-in-law of informant has been shot dead by three unknown persons. The name of these petitioners has come during investigation merely on suspicion. It has further been submitted that in paragraph
Patna High Court CR. MISC. No.19980 of 2019(4) dt.03-07-2019 2/2 nos. 41 and 42 of the case diary witnesses have disclosed the name of three other accused persons. They have not disclosed the name of these petitioners. Petitioners have Tea stall near the place of occurrence and they have been implicated in this case merely on suspicion. Petitioners are father and son. Petitioners are in custody since 16.1.2019 having no criminal antecedent.
Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the CJM Muzaffarpur in connection with Sakra P. S. Case No. 19 of 2019, GR no. 215 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioners.
