====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-12-2021 Heard Mr. Ram Prawesh Nath Tiwary, learned counsel for the petitioner and Mr. Ganesh Prasad Singh, learned Additional Public Prosecutor appearing for the State.

Petitioner seeks regular bail in connection with Govindpur P.S. Case No. 247 of 2020 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation as per the First Information Report is that the Police intercepted a pick-up Bolero van and recovered a total quantity of 314.625 litres of illicit liquor from the same and the petitioner was arrested.

No.30500 of 2021(2) dt.08-12-2021 2/3 Learned counsel for the petitioner submits that the petitioner is driver of the vehicle in question and he was engaged by its owner for the purpose of delivery of paddy from Nawada and he was not aware about the illicit liquor being loaded by its owner in the vehicle. Learned counsel further submits that the petitioner has got no criminal antecedent and he is in custody since 8.12.2020. Learned counsel next submits that the charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent, he is in custody since 8.12.2020, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II cum
