JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case, initially, registered for the offences punishable under Section 394 of the Indian Penal Code and subsequently, Section 411 of the Indian Penal Code was added.

Petitioner is said to have been caught with stolen motorcycle and apart from this, petitioner does have criminal antecedent of five cases.

Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Raniganj P.S. Case No. 80 of 2014

Patna High Court Cr.Misc. No.45988 of 2016 (3) dt.02-12-2016 2/2 pending in the court of Additional Chief Judicial Magistrate-III, Araria stands rejected.

However, it is apparent from perusal of impugned order that petitioner is in jail custody since 15.04.2015 and, therefore, the trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
