In this case, the petitioner is seeking bail in connection with Hajipur Sadar P.S. Case No.689 of 2019, registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code and Sections 4, 6, 8 and 10 of POCSO Act.

Allegation has been made that the co-accused including the petitioner have kidnapped the minor victim girl with intention to kill her or to sell elsewhere for illegal activity. Section 164 Cr.P.C. statement, which she made before the Magistrate, has given heavy description of horrible occurrence which took place.

Patna High Court CR. MISC. No.18280 of 2020(3) dt.28-08-2020 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner for the present. Accordingly, the prayer for bail is rejected for the present.

However, the petitioner is at liberty to renew his prayer for bail after completion of one and half year of his jail custody.
