JUSTICE SUDHIR SINGH ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 414 of the Indian Penal Code and 25(1-b) a, 26,35 of Arms Act.

The allegation against the petitioner is that from his possession one country made pistol loaded with six live cartridges was recovered from his possession.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.07.2016. Charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. One pistol loaded with six live cartridges is said to have been recovered from the possession of

Patna High Court Cr.Misc. No.45872 of 2016 (2) dt.21-10-2016 2/2 the petitioner. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manish Pandey, learned Judicial Magistrate,1st Class, Muzaffarpur in connection with Kanti P.S.Case No. 310 of 2016.
