KUMAR ORAL ORDER 12-12-2018 This case has been listed under the heading "To Be Mentioned" at the instance of opposite party No. 2 State Bank of India, Agriculture Development Branch, Gopalganj for modification/clarification of the order dated 20.11.2018 passed in Cr. Misc. No. 66474 of 2018 in which petitioner was granted provisional bail for eight months with a condition that he would deposit Rs. 4 lacs in the said period which was taken by him as a loan after depositing gold ornaments which were found to be fake.

It has been submitted on behalf of Bank that petitioner had taken two loans of 4 lacs each and in the FIR the loan amount has been mentioned as 8 lacs, however, in the order

Patna High Court Cr.Misc. No.66474 of 2018(3) dt.12-12-2018 2/2 passed by the Sessions Judge only loan of Rs. 4 lacs has been mentioned which has come in the order passed by this Court also.

It is clarified that payment of amount as directed by this Court is only for the purpose of grant of bail and bank is free to realize the remaining amount which is found due against petitioner in accordance with law and remedy available to the bank.
