JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 04-10-2016 In view of the objection raised by the learned AC to SC10 appearing on behalf of the respondents that the impugned order passed by the respondent S.D.O. is appealable and revisable under the provisions of Section 9 of The Bihar Agriculture Land (Conversion for Non-Agriculture Purposes) Act, 2010, the learned counsel appearing on behalf of the petitioners seeks permission to withdraw the present writ petition with a liberty to approach the appellate authority for grant of appropriate relief(s) to the petitioners with respect to the lands in question. Permission is accorded.
The writ petition stands dismissed as withdrawn with the liberty aforesaid.
If an appropriate appeal is filed on behalf of the
Patna High Court CWJC No.12798 of 2015 (2) dt.04-10-2016 2/2 petitioners, after impleading all the necessary parties, and bringing on the record all the relevant materials within a period of one month from today with a certified copy of the present order and if it is found to have barred by limitation and if any petition is filed on behalf of the petitioners for condonation of such delay, then the learned prescribed appellate authority shall take into consideration that on a bonafide legal advice, the present writ petition was filed on behalf of the petitioners on 17.8.2015 and that remained pending before this Court till date.
