2. The petitioner is in custody in connection with Jairampur P.S Case No. 3 of 2026 registered for the offences punishable under Sections 137(2) and 96 of the BNS, 2023.

3. As per prosecution case, petitioner has kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that has got no criminal antecedent as stated in paragraph no. 3 fo the bail petition. It is next submitted that the petitioner and the victim were acquainted with each other and were in a love relationship. It is also submitted that petitioner is

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR, statement of the victim under Section 183 of the B.N.S.S and impugned order, it appears that she has stated in her statement under Section 183 of the B.N.S.S that she went with the petitioner on her own sweet will and she married with the petitioner in temple during the way to Kolkata and there is no any allegation about the sexual assault against the petitioner. The petitioner and the victim were acquainted with each other and were in a love relationship.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-cum-Exclusive Special Judge (POCSO), Sheikhpura in connection with Jairampur P.S Case No. 3 of 2026.
