2. The petitioner seeks bail in a case registered for the offence punishable under Sections 191(2), 190, 103(1), 115(2), 109(1) of the B.N.S.
3. The allegation in the First Information Report has been made against 10 accused persons that on account of an altercation with regard to land dispute, all these persons along with 2-3 unknown persons started assaulting the mother of the informant and when others intervened in the matter, they were also assaulted. Further allegation has been made against Arjun Mahto and his wife Sheela Devi, present petitioner, that they
Patna High Court CR. MISC. No.19420 of 2025(3) dt.21-05-2025 2/3 pushed the mother of the informant on the ground several times and in such course, the mother of the informant and others also got injured, who was subsequently taken to the hospital, where the mother of the informant died.

Learned counsel for the petitioner submits that it would be apparent from a bare perusal of the First Information Report itself that the entire incident started with a verbal altercation between the parties with regard to land dispute and later on escalated into a physical fight. It has further been submitted that initially there is general allegation on all 10 persons of assaulting the deceased and other persons, however in the later part of the FIR, the allegation has been made specifically on this petitioner and her husband Arjun Mahto. Learned senior counsel for the petitioner however, brings the fact to the notice of the Court that during the course of investigation, in para-4, 5 of the case diary, it would appear that the allegation of assault upon the deceased does not remain confined to the petitioner and her husband but is made general and omnibus on other accused persons also that she was assaulted by means of fists and slaps and was pushed on the road. The petitioner, who is a lady, is already in custody since 31.01.2025 with no criminal antecedent.

5. Learned APP for the State has opposed the application for anticipatory bail.
6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Lohiyanagar P.S. Case No. 72 of 2024. (Soni Shrivastava, J) devendra/- U T
