JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-05-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as, Mr. J.N. Thakur, learned APP for the State.

The petitioner apprehends his arrest in connection with Harsidhi P.S. Case No. 511 of 2020, registered for the offences punishable under Sections 447, 448, 341, 323, 324, 308, 427, 379, 504, 506/34 of the Indian Penal Code.

The allegation against the petitioner is that he assaulted the informant by farsa on his head.

Learned counsel for the petitioner has submitted that there is admitted land dispute between the parties. The petitioner is a person of clean antecedents and both the parties have compromised the case as amicable relation restored between the parties.

Considering the fact that both the parties have resolved their matter amicably, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 511 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
