The petitioners are apprehending their arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 341, 379, 504 of the Indian Penal Code. It is alleged that the accused persons assaulted the complainant and his father. It is further alleged that petitioner no. 1 namely Ashim Prawez @ Juganu snatched Rs. 11,500/- from the complainant, when petitioner no. 3 namely Md. Gulab snatched Rs.2,000/- from the pocket of complainant's father
Patna High Court Cr.Misc. No.36343 of 2015 (2) dt.08-09-2015 and petitioner no. 2 namely Salim Parwez @ Guddu took away the box containing jewellary worth Rs. 30,000/- and the sale deed in question.
It is submitted by the learned counsel for the petitioners that no injury was caused to the complainant and his father and in the background of Title Partition Suit between the parties, the accusation has been levelled. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with C.R. Case No. 772 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
