JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Palasi P.S. Case No. 205 of 2016 instituted under Sections 341, 323, 325, 307, 379, 504/34 of the Indian Penal Code. The allegation, in brief, is that the accused persons came and started assaulting and the petitioner gave a rod blow to the informant's son. It is submitted that there is partition dispute between both sides. The only allegation is that the petitioner gave single blow on the forehead i.e. simple in nature and has got no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, namely, Md. Asfaque@ Md. Isfaque

Patna High Court Cr.Misc. No.5681 of 2017 (2) dt.07-02-2017 in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.III, Araria in connection with Palasi P.S. Case No. 205 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
