The petitioner is seeking anticipatory bail in connection with Manjhagarh P.S. Case No. 226/2018 registered under Sections 147, 148, 448, 323, 324, 325, 307, 504 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is an allegation that this petitioner had assaulted the mother of the informant on her hand with iron rod. Submission is that in the case diary although the learned Sessions Judge noticed that the injury was caused, but the opinion regarding the injury was not found in the case diary. Learned counsel submits that considering the fact that petitioner and informant are co-sharer and that because of some family disputes the present F.I.R. has been lodged making false and frivolous allegation, the petitioner
Patna High Court CR. MISC. No.18248 of 2019(2) dt.01-04-2019 2/2 may be granted privilege of anticipatory bail. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the facts and circumstances of the case wherein as per allegations the petitioner had assaulted the mother of the informant on her hand by iron rod but no specific injury has been pointed out in the impugned order as also that the parties are said to be the co-sharers having some family dispute, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Manjhagarh P.S. Case No. 226/2018, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
