JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-10-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is in jail custody since 30.12.2019 in connection with Sidhwalia P.S. Case No. 238/2019 registered for the offences punishable under Sections 363, 366A, 302, 201 and 34 of the Indian Penal Code.

Although, the petitioner is named in the first information report but only suspicion has been raised against him due to previous dispute. Moreover, perusal of case diary goes to show that not a single prosecution witness claimed to have seen the petitioner in the company of deceased prior to recovery of her dead body.

Considering the aforesaid facts and circumstances as

No.20505 of 2020(3) dt.14-10-2020 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/concerned court in connection with Sidhwalia P.S. Case No. 238/2019.
