JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-07-2022 Earlier, vide order dated 07.06.2022, on the submission of learned counsel for the petitioners that during pendency of this petition, petitioner nos. 1, 2 and 4 have been arrested, the petition in respect of petitioner nos. 1, 2 and 4 has already been dismissed.
So far as, prayer for anticipatory bail of sole petitioner i.e. petitioner no. 3 is concerned, as per F.I.R., this petitioner is alleged to have caught husband of the informant from back side. It is submitted that specific allegation of inflicting knife blow is against co-accused Katar Sahani. Present case is
Patna High Court CR. MISC. No.31056 of 2021(3) dt.19-07-2022 2/2 counter blast of Vaishali P.S. Case No. 131 of 2019 instituted under Sections 307, 341, 343, 504 and 506/34 of the I.P.C. against the prosecution side. Petitioner has got no criminal antecedent.
Considering the nature of accusation and clean antecedent of petitioner, let the sole petitioner i.e. petitioner no. 3 namely Akshay Sahani, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S.
