Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

On dacoity being committed in the shop of the informant the First Information Report was registered against unknown. The name of the petitioner sprang up on confession of the co-accused during investigation. It is submitted by learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner and petitioner has no criminal antecedent. A statement to that effect has been made in para 3 of the petition. The aforesaid facts constitute ground for consideration of regular bail, if the petitioner surrenders within

Patna High Court Cr.Misc. No.36643 of 2015 (2) dt.10-09-2015 2/2 a period of six weeks in connection with Belhar P.S. Case No. 134 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Banka.

With the observations above, the application stands disposed off.
