The petitioner seeks bail in a case registered under Sections 379 & 411 of the Indian Penal Code. The prosecution case, in brief, is that the petitioner committed theft of mobile of informant's sister-in-law and demanded Rs. 5,000/- It is also alleged that the petitioner misbehaved with the sister-in-law of the informant. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 24-01-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. The petitioner is owner of an E-rickshaw and there was a dispute in respect of payment of
Patna High Court CR. MISC. No.19783 of 2019(3) dt.24-04-2019 2/2 fare in question and she has falsely implicated the petitioner in the case.
On behalf of the State, it is submitted that the stolen mobile of the informant is said to have been recovered from the petitioner. He had misused the said mobile by making calls to the sister-in-law of the informant. He misbehaved with the said lady.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Pirbahore P.S. Case No. 54 of 2019 is rejected at this stage. (Sudhir Singh, J) A.K.V.//- U T
