The petitioners are apprehending arrest in a case registered for the offences punishable under sections 323, 379, 420, 465, 467 and 406 of the Indian Penal Code. The prosecution case is that the complainant gave Rs.5400/- to petitioner no.1 Shivadhar Singh for opening account in the financial company but on demand money could not be returned when the informant came to know that the accused persons not only cheated him but several persons also. Considering the fact that the complaint was filed in 1999 and the order of cognizance was passed on 08.06.2000,

Patna High Court Cr.Misc. No.38399 of 2015 (2) dt.24-09-2015 2/2 this court is not inclined to entertain the present anticipatory bail application. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Complaint Case No.369 of 1999, pending before the learned SDJM, Bikramganj (Rohtas).

With the above observation, this application is, accordingly, disposed off.
