21-08-2021 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Motihari Town P.S. Case No. 336 of 2020, registered for the offence under Section 302 of the Indian Penal Code.
As per the prosecution case, this petitioner is alleged to have inflicted repeated knife blow on the chest of husband of the informant, as a result of which, he died on way to hospital. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. In fact, the informant was having love affairs with someone else, which was being opposed by her husband (deceased) and this petitioner and this is the reason that deceased was murdered by someone else and
Patna High Court CR. MISC. No.30391 of 2021(2) dt.21-08-2021 2/2 petitioner was falsely implicated by the informant. Petitioner is in custody since 15.06.2020. Chargesheet has been submitted. Learned A.P.P. for the State has vehemently opposed the bail petition and submitted that petitioner gave knife blow to the informant's husband, which caused injuries on many places on his chest, as a result of which, he (deceased) died on way to hospital.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and as such, same is rejected.
