JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under sections 498(A), 420/34 of the Indian Penal Code. The petitioner submits that he is innocent and has been falsely implicated in this case. The allegations are general in nature. He further submits that he is willing to keep his wife i.e. Opposite Party No.2 with due care, love and affection but she in paragraph 9 of the complaint petition has categorically stated that she is not ready to live with the petitioner. The petitioner submits that the Opposite party No.2 is an ambitious lady and has filed a Divorce Case against him. The petitioner is a Grade 'D' employee

Considering the facts and circumstances of the case, the petitioner Ashok Kumar Sinha is directed to be released on anticipatory bail, in the event of his arrest/surrender, in connection with Complaint Case No.3923(C) of 2013 on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumari, Judicial Magistrate, Patna with the condition that he will pay a sum of Rs.2700/- per month as maintenance to the complainant by 15th of following month in her Bank Account subject to any decision regarding maintenance/ alimony in the Divorce Case/ Maintenance Case, if any.
