2. The petitioner apprehends his arrest for the offences alleged under Sections 379, 420 and 411 of the Indian Penal Code; Rule 40 of the B.M.M.C. Rules 1972; Sections 3 and 4 of the Bihar Mineral Prevention of Illegal Mining, Storage and Transportation Act, 2003; and Section 15 of the Environment Protection Act, 1986 registered in connection with Makhdumpur Tehta P.S. Case No. 08 of 2019.

3. It is submitted that the petitioner has been falsely implicated in connection with recovery of sand illegally being transported on his tractor. It is submitted that the petitioner is the owner of the tractor but he has no knowledge about the sand being loaded on the tractor by the driver. The petitioner is also accused in a case of similar nature in which he is on bail.
