2. The petitioner is apprehending arrest in connection with Complaint Case No. 1282 of 2024 instituted under Sections 341, 323, 498A, 504, 506/34 of the Indian Penal Code corresponding to sections 126(2), 115(2), 85, 352, 351 of the Bhartiya Nayay Sanhita, 2023.

3. As per the prosecution story, the informant alleged that she got married to the petitioner in the year 2021 and the family gave dowry worth Rs. 15 lakh. As the petitioner family demanded the same stating that she is in the government job, for the same reason, she was regularly tortured. A Panchayati also took place but without any success. Later, Matrimonial Case No. 147 of 2022 was filed in which she filed Maintenance Case No. 90M/2023. As she was in dire need of her valuable, went to their place where she was assaulted. This led to the FIR.

4. Learned counsel for the petitioner submits that the fact that he has filed petition for restitution of conjugal rights shows that he wants to continue with the relationship.

5. On the other hand, learned counsel for the informant submits that this is the second time, she has been assaulted, firstly, when the case was registered under Domestic Violence Case No. 22 of 2024, this followed the cases before the competent Civil Court and when she went to take back the belongings, assaulted.

6. Considering the submissions of the parties and the way, the complainant has been treated by the petitioner despite being a government employee, earlier also a case was
