The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379, 354A and other allied sections of the Indian Penal Code. Specific allegation of assault causing grievous injury is against petitioner no. 1. Petitioner no. 2 along with other FIR named accused persons are alleged to have tried to outrage the modesty of informant's wife.

It is submitted that there is case and counter case. Petitioners have been falsely implicated in this case due to land dispute between the parties. Petitioner no. 2 claims clean

Counsel for informant vehemently opposed the prayer for bail.

Considering the specific allegation of assault against petitioner no. 1 causing grievous injury, I am not inclined to enlarge Sriprasad Yadav, petitioner no. 1 on anticipatory bail. Accordingly, the same is rejected.

So far the case of Ranjeet Kumar Yadav petitioner no. 2 is concerned, there is general and omnibus allegation, petitioner no. 2 in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Madhubani in connection with Babubarhi P.S. Case No. 127 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
