JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 The petitioner seeks regular bail in connection with Excise Special Case No. 1057 of 2018 arising out of Prahar Bal Excise Case No.39/18 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 20.25 litres of Indian made foreign liquor.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has no criminal antecedent and has been in judicial custody since 06.09.2018 and there is no recovery either from the house or from the possession of the petitioner.

Heard learned A.P.P. also.

No.64929 of 2018(2) dt.05-11-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II - cum - Special Judge, Araria in connection with Excise Special Case No. 1057 of 2018 arising out of Prahar Bal Excise Case No.39/2018.

It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds (Vinod Kumar Sinha, J) sunilkumar/- U T
