JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 02.03.2022, charge-sheet has been submitted in the case and has antecedent of three cases. Allegation is of recovery of 147 litres of liquor from an auto.

Learned counsel for the petitioner submits that the petitioner is neither the driver nor the owner of the auto nor he was arrested from the spot and his name transpired in the confessional statement of co-accused.

Considering the fact that the petitioner is in custody since 02.03.2022, charge-sheet has been submitted in the case, was not arrested from the spot and his name transpired in the confessional statement of co-accused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Aurangabad Muffasil P.S. Case No. 245 of 2021.
