2. The petitioner seeks regular bail in connection with Shahpur P.S. Case No. 173 of 2018 registered for the offence under Sections 363 and 365 of the Indian Penal Code.

3. As per the prosecution case, the minor daughter of the informant went missing from his house on 06.06.2018.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 20.12.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. The F.I.R. is of year 2018. The statement of the victim was recorded under Section 164 of Cr.P.C, in which she

Patna High Court CR. MISC. No.22679 of 2025(5) dt.01-09-2025 2/2 has taken the name of the petitioner. The Statement was recorded on 14.06.2018, thereafter, the petitioner was absconding.

7. Considering the aforesaid facts and circumstances and from the statement of the victim it appears that the petitioner has participated in the kidnapping of the victim and the allegation is of serious nature, I am not inclined to grant bail to the petitioner.

8. Accordingly, this application for regular bail is hereby rejected.
