2. The petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-B)(a) and 26, 27, 35 of the Arms Act.
3. As per the prosecution case, there is a recovery of two country made pistols, one live cartridge, four empty cartridges, one bracelet and four mobile phones from the room of the petitioner.
4. Learned counsel for the petitioner submits that a false recovery of two country made pistol, one live cartridge and four empty cartridges have been shown from the room of the petitioner and there is no independent witness to the search and seizure. It has also been submitted that the petitioner is a
Patna High Court CR. MISC. No.27921 of 2026(3) dt.10-06-2026 2/2 young boy aged about 23 years and is also pursuing his studies. No recovery has been made from his personal or conscious possession as he was not caught on the spot. The petitioner is in custody since 17.12.2025 without any criminal antecedent and the charge-sheet has already been submitted.
5. Learned APP for the State opposed the bail petition.
6. Taking into consideration the facts and circumstances of the case and also considering the fact that the petitioner has remained in custody since 17.12.2025 and charge sheet has already been submitted coupled with the fact that the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Lakhisarai/concerned Court below in connection with Mednichowki P.S.
