JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act. Petitioner is in jail custody since long on the accusation that one country made loaded katta and one live cartridge were recovered from his possession and taking note of the aforesaid fact as well as criminal antecedent of the petitioner, his prayer for bail was earlier rejected by this court vide order dated 05.04.2016 passed in Cr. Misc. No. 14204 of 2016 giving liberty to petitioner to renew his prayer for bail, if his trial is not concluded within three months.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (Muffasil) P.S.
