JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 353, 379, 427, 436, 504 of the Indian Penal Code. It is alleged that 35 F.I.R. named persons including this petitioner and 500 unknown persons set the house of Shankar Sah on fire and looted articles.
Learned counsel for the petitioner submits that he has falsely been implicated in this case. Allegation against the petitioner is general and omnibus. Similarly situated co-accused persons have already been granted bail by the co-ordinate Bench of this Court vide order dated 24.03.2023 passed in Cr. Misc. No. 1990 of 2023. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhubani in connection with Padaul P.S. case no. 123 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
