The petitioner apprehends her arrest in Arer P.S. case No. 100 of 2016 under Section 307, 354B, 379 and other Sections of the Indian Penal Code.

The informant alleged that Singheshwar Sah, Deo Chandra Sah @ Deva, Narayan Sah, wife of Deva Sah and wife of Singheshwar Sah, the petitioner, came to his field and began to abuse because the informant and his wife were harvesting the crops. The allegation against the petitioner is that she snatched Hasuli made of silver from the neck of wife of the informant. The learned counsel for the petitioner submits that there is no allegation of assault against the petitioner. The petitioner, who is a lady, has falsely been implicated in the case on

Patna High Court Cr.Misc. No.14097 of 2017 (3) dt.30-06-2017 2/2 account of land dispute. The entire family members of the petitioner have been made accused in the case. Considering the facts that there is land dispute between the parties and petitioner being a lady is alleged to have snatched Hasuli from the neck of the wife of informant, which appears to be ornamental, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in Arer P.S. Case No. 100 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
