JUSTICE ARUN KUMAR ORAL ORDER 12-04-2017 Heard learned counsel for the petitioners and the learned APP appearing on behalf of the State. Petitioners apprehend their arrest in connection with Deo P.S. Case No.11 of 2017 registered under Sections 147/148/149/323/427/307/353 of the Indian Penal Code. Allegation in brief is that the petitioners set fire to a truck on the road as it met with an accident in which one person was killed. Further allegation is that when police reached at the place, mob pelted stones.
Learned counsel for the petitioners submits that these petitioners are not involved. Only they are residents of the
Patna High Court Cr.Misc. No.15244 of 2017 (2) dt.12-04-2017 2 / 2 neighbourhood where the occurrence took place and, therefore, the police implicated them. No specific allegation is levelled against these petitioners and there is no injury caused to any police personnel as is reflected from the impugned rejection order of the learned Sessions Judge and these petitioners have got no criminal antecedent.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Deo P.S. Case No.11 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
