ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 5.1.2016 in connection with Mithanpura P.S. Case No.234 of 2015 registered for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR, but later on, on the basis of confessional statement made by co-accused Shanu Kumar, the petitioner has been taken into custody. It is further submitted that till date, no T.I. Parade has been conducted in connection with the present case.

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.40212 of 2016 (4) dt.24-11-2016 2/2 circumstances and that the co-accused Shanu Kumar has now been extended the privilege of regular bail in connection with the present case in Criminal Miscellaneous No.21073 of 2016, vide order dated 11.07.2016, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate (East), Muzaffarpur, in connection with Mithanpura P.S. Case No.234 of 2015.
