JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 30-03-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Darauli P.S. Case No. 192 of 2020, registered for the offences punishable under Sections 341, 323, 337, 338, 307, 379, 506, 504 & 34 of the Indian Penal Code.

As per allegation, the present petitioner started abusing the members of informant party. On protest the FIR named 10 accused persons started assaulting them. The allegation against the present petitioner is that he assaulted on the head of Vijay Kumar Yadav with iron rod.

Learned counsel for the petitioner has submitted that the

No.32264 of 2021(2) dt.30-03-2022 2/2 alleged injured Vijay Kumar Yadav has although received injuries and one of them is grievous in nature but the real fact is that injured Vijay Kumar Yadav, badly assaulted Ramashish Yadav, the member of petitioner side, who died and in this respect a case i.e. Darauli P.S. Case No. 191 of 2020 has been lodged. The fardbeyan of Darauli P.S. Case No. 191 of 2020 shows that injured Vijay Kumar assaulted on the head of the deceased Ramashish Yadav.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class in connection with Darauli P.S. Case No. 192 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
