JUSTICE SANJAY PRIYA ORAL ORDER 30-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 392 of the Indian Penal Code. It is alleged by the driver of a pick-up van who is the informant of the case, that on the date of occurrence, four persons on the motorcycle intercepted the pick-up van and committed loot pat and taken valuables from his personal possession. It is alleged in the written report that one Guddu who was sitting in the pick-up van identified the petitioner. The counsel for the petitioner submits that no Test Identification Parade has been held by the police till date. The informant and Guddu have filed a petition before the lower court annexed as Annexure-2 wherein they have stated that the

Be that as it may, from the written report itself it appears that the name of the petitioner has been disclosed by one Guddu. It has further been submitted that during trial Guddu and the informant Ashok Singh have been examined as PWs-3 and 4 and during their evidence, they have not disclosed the name of the petitioner.

In such circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Ara, in connection with Sahar P.S. Case No. 77 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
