Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 25 (1-b)a,26/35 of the Arms Act.

The brief fact of the case is that SHO Deep Narain Singh of Shahpur P.S. along with other police force on 01.10.2019 proceeded for the purpose of investigation and arresting of accused of Shahpur P.S. Case No. 275 of 2019. When he reached Chhoti Mathia where he got massage that Mukun Pandey, Priyanshu Pandey were looking for committing some crime. The informant along with police force reached there. The petitioner started escaping from there but the police

Patna High Court CR. MISC. No.18537 of 2020(2) dt.04-06-2020 2/2 force apprehended there and after search a country made pistol was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case due to local politics. He submits that nothing has been recovered from the possession of the petitioner and he is in custody since 11.10.2019.

Learned counsel for the State vehemently opposes the prayer for bail.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Bhojpur, Ara in connection with Shahpur Police Station Case No. 276 of 2019.
